This week, the Supreme Court of the United States refused to hear a case presented by Amazon.com in regards to the internet tax law in New York. Under the current law, any sales made in the state of New York are required to collect sales tax. This law was upheld even though Amazon is located in Seattle, Washington. Amazon is arguing that it is against the law for the government to collect sales tax from business that don’t have facilities in that state. However, New York law states that companies without a physical presence in the state must pay sales tax if they use a local resident to solicit business online. Because the justices refused to hear the case, it leaves the current law in tact. The justices also offered no comment in reference to the case. The law passed in the Senate but has stalled in the House of Representatives. According to Dick Durbin, one of the creators of the Act, the law will close the tax loophole. It will level the playing field between those online and those local.
For businesses that sell online and in store, the law won’t affect them much, but for those who only do business online, it may hurt them.
